Summary

The bill prohibits school athletic programs from allowing biological males to participate or compete in programs allocated for women. The Act designates any program that allows males in women’s sports as a violation of Title IX of the Education Amendments of 1972. The bill further distinguishes that sex is recognized in reference to one’s reproductive biology and genetics at birth. The Office for Civil Rights in the U.S. Department of Education will oversee enforcement of this Act.

Goal

  • Maintain and uphold Title IX protections of women and corresponding spaces.

Analysis

Title IX provides protection on the basis of sex — not gender or gender identity. This is necessary for the protection of women and fairness. The Protection of Women and Girls in Sports Act ensures compliance with this crucial Title.
