Summary
This bill requires schools to inform parents of their child’s expressed gender identity or discomfort with their biological sex. School employees must also receive parental consent to attempt to affirm their child’s gender identity if incongruent with his sex. School Employees cannot pressure or coerce a student or his parents into proceeding with an intervention to affirm an identity inconsistent with his sex, nor may school employees refer or recommend a student seek medical or third party intervention to affirm an identity inconsistent with his sex without expressed parental consent.
Any school violating this Act is ineligible for Federal funding, and a qualified party may seek civil action in response to a designated violation of this Bill. Such action may be brought against any elementary or secondary school receiving Federal financial assistance, as well as any governmental entity assisting an elementary or secondary school.

Analysis
This bill prevents educators and school employees from withholding information from parents about their child’s expressed gender identity and from encouraging hiding that information or recommending options to affirm the children’ s purported identity. In doing so, the Empower Parents to Protect Their Kids Act encourages parental involvement in their children’s education. The bill, therefore, protects parental rights in education.
